These Terms and Conditions ("Terms") govern the purchase of components, replacement parts, and accessories from 3C-Easy Markham ("3C-Easy Markham," "we," "us," or "our") through our website at 3ceasymarkham.ca.
By placing an order through our website, you ("the Customer") acknowledge that you have read, understood, and agreed to be bound by these Terms.
1. Scope of Online Sales
Our website exclusively offers electronic components, replacement parts, and accessories for sale.
Repair services are not sold, booked, or authorized online. Any repair services offered by 3C-Easy Markham are provided exclusively in-store and remain subject to device inspection, service approval, parts availability, and separate in-store documentation or written service terms as applicable.
2. Product Descriptions, Identification, & Compatibility
Product descriptions, model references, and compatibility information are provided for general identification and compatibility purposes only.
Any manufacturer, device, or brand name used on this website is solely for identifying product compatibility and does not imply any affiliation, authorization, or endorsement unless expressly stated otherwise.
Unless expressly stated in the product listing, products sold by 3C-Easy Markham may include aftermarket, compatible, salvaged, refurbished, or otherwise non-OEM replacement parts.
While we make reasonable efforts to present accurate product information, we do not warrant that product descriptions, images, specifications, compatibility references, or other website content are always complete, current, or error-free.
3. Components, Tools, Installation & Use
All components are sold as parts only, unless expressly stated otherwise.
No tools, adhesives, installation materials, or installation services are included, unless expressly stated in the product listing.
Customers are responsible for confirming compatibility before purchase and for ensuring proper installation, testing, handling, and use after delivery.
Except where otherwise required by applicable law, 3C-Easy Markham is not liable for any losses, defects, malfunctions, or damages resulting from improper installation, improper handling, misuse, modification, technician error, attempted installation, or use inconsistent with the product's intended purpose.
4. Pricing, Payment & Taxes
All prices displayed on the website are in Canadian Dollars (CAD), unless expressly stated otherwise.
Applicable taxes, including Ontario HST where required by law, will be charged at checkout.
Full payment is required at the time of checkout, unless an alternative payment arrangement is expressly offered by us.
Prices, product availability, shipping fees, and promotional offers may be subject to change from time to time. We reserve the right to correct pricing errors, display errors, or obvious inaccuracies, including after an order has been placed, subject to applicable consumer protection laws.
5. Order Acceptance & Availability
All orders are subject to acceptance, stock availability, payment authorization, and verification.
Submitting an order does not guarantee its acceptance or fulfillment. Before shipment, we may decline, limit, or cancel an order where reasonably necessary, including for pricing errors, stock unavailability, listing inaccuracies, shipping limitations, suspected website misuse, or verification concerns.
If an order is cancelled after payment has been received, a refund will be issued to the original payment method, subject to normal payment processing times.
6. Shipping, Delivery & Carriage
Shipping methods, fees, and estimated transit times are generally indicated at checkout or otherwise described in our Shipping Policy.
All delivery times are estimates only and are not guaranteed, unless expressly stated otherwise in writing.
The risk of loss and liability for shipping transfers in accordance with applicable law and the carrier's applicable delivery status.
We are not responsible for carrier delays, customs delays, weather disruptions, service interruptions, force majeure events, or other circumstances beyond our reasonable control.
Customers are responsible for ensuring that shipping and contact information provided at checkout is accurate, complete, and deliverable. We are not responsible for delays, delivery failures, losses, or additional costs resulting from incorrect or incomplete information provided by the Customer.
7. Order Verification & Fraud Prevention
All orders are subject to screening, verification, and acceptance before shipment.
To help protect customers, payment systems, and business operations from fraudulent, unauthorized, or otherwise suspicious transactions, 3C-Easy Markham reserves the right, where reasonably necessary, to delay processing, place an order on hold, request additional verification, refuse shipment, cancel an order, limit quantities, or issue a refund where payment, billing, identity, security, or transaction authenticity cannot be reasonably confirmed.
We are not obligated to fulfill or release an order that cannot be reasonably verified for security or fraud prevention purposes.
For security and risk management purposes, we may also decline orders that appear inconsistent, incomplete, unverifiable, high-risk, or otherwise unsuitable for processing by our store.
8. Warranty Coverage
Warranty coverage for products sold on our website is governed by the applicable policy in effect at the time of purchase, including our Component Warranty Policy and our Accessories Replacement Policy, as applicable. These policies form an integral part of these Terms.
Unless expressly stated otherwise, warranty coverage is limited to verifiable manufacturing or material defects only.
Without limitation, warranty coverage does not apply to:
- Improper installation
- Installation-related damage
- Accidental damage
- Physical damage
- Liquid damage
- Misuse
- Abuse
- Negligence
- Unauthorized modification
- Attempted repair
- Normal wear and tear
- Incompatibility due to incorrect model selection or customer error
Proof of purchase is required for all warranty claims, and verification of the defect may be required before a replacement, exchange, store credit, refund, or other remedy is approved.
Nothing in this section limits or excludes non-waivable rights or remedies under applicable consumer protection laws, including any legal warranty rights that may apply to Québec consumers.
9. Returns, Replacements & Consumer Rights
Returns, replacements, exchanges, and related remedies are subject to the applicable policy in effect at the time of purchase.
Nothing in these Terms limits, excludes, or waives any non-waivable rights or remedies under the Ontario Consumer Protection Act, 2002, any legal warranty applicable to Québec consumers, or any other applicable law.
Where verification of a reported defect, issue, or non-conformity is required, we reserve the right to inspect, test, or otherwise evaluate the item before approving a return, replacement, refund, or warranty remedy.
10. Limitation of Liability
To the maximum extent permitted by applicable law, 3C-Easy Markham is not liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to loss of use, loss of revenue, loss of profits, loss of data, loss of business opportunity, technician labor costs, third-party repair costs, or downtime arising from or related to any product sold on our website.
To the maximum extent permitted by applicable law, our total liability for any claim related to a product is limited to the amount actually paid for the specific product giving rise to the claim.
These limitations apply except where prohibited or restricted by applicable law.
11. Accuracy of Customer-Provided Information
Customers are responsible for providing accurate and complete order information, including shipping details, billing details, contact information, and selected products.
3C-Easy Markham is not responsible for any errors, delays, losses, delivery failures, or other issues arising from inaccurate, incomplete, outdated, or misleading information provided by the Customer.
12. Disputes & Complaints
We are committed to addressing customer concerns fairly, reasonably, and professionally.
Before initiating a formal dispute, chargeback, or third-party complaint, customers are encouraged, where reasonable, to communicate directly with 3C-Easy Markham and provide sufficient details, documentation, and a reasonable opportunity for review and response.
Where a matter cannot be resolved directly, it may be escalated to an appropriate third-party forum or legal process, including the Better Business Bureau or any court of competent jurisdiction, as applicable.
Nothing in this section limits any non-waivable rights under applicable law.
13. Intellectual Property & Compatibility References
Unless expressly stated otherwise, all trademarks, trade names, brand names, model names, and logos mentioned on this website remain the property of their respective owners and are used solely for compatibility identification, nominative reference, or descriptive purposes.
3C-Easy Markham is not affiliated with, endorsed by, or authorized by the respective brand unless expressly stated otherwise.
14. Changes to These Terms
We may update these Terms from time to time, subject to applicable law.
The version in effect at the time the order is placed will generally apply to that purchase, unless a revised version is required by law or expressly agreed upon by the Customer.
