In-Store Terms and Conditions
3C-Easy Markham

These Terms and Conditions (“Terms”) apply exclusively to in-store transactions and repair services provided at 3C-Easy Markham’s physical location.
They do not apply to online purchases of components or accessories, which are governed separately.
By proceeding with any in-store purchase or repair service, you (“the customer”) acknowledge that you have read, understood, and agreed to these Terms.
1. Parts Disclaimer
Unless expressly stated in writing, 3C-Easy Markham (“we,” “us,” or “the Company”) does not supply Original Equipment Manufacturer (OEM / OE) replacement parts.
All replacement components used in repairs are aftermarket, third-party, or non-OEM parts.
Any manufacturer or brand names referenced are used solely for identification and compatibility purposes and do not imply OEM origin, endorsement, authorization, or affiliation.
2. Data Backup & Data Loss
You acknowledge and confirm that all personal data has been fully backed up prior to repair.
To the fullest extent permitted by law, 3C-Easy Markham shall not be responsible for any data loss, corruption, or inaccessibility arising from:

Device condition
-
Software issues
-
Hardware failure
3. Third-Party Repair Disclosure
You acknowledge that 3C-Easy Markham is an independent, third-party repair provider and is not authorized by device manufacturers.
While we will make reasonable efforts to disclose known risks or limitations prior to repair, returns, refunds, or disputes based solely on general third-party repair disadvantages or customer unfamiliarity will not be accepted, subject to applicable consumer protection laws.
4. Passcode & Access Responsibility
Providing and remembering all passcodes, passwords, or biometric access credentials remains solely your responsibility.
All fees remain payable regardless of repair outcome if access cannot be completed due to missing, incorrect, or forgotten credentials.
5. Water Resistance & Manufacturer Seals
You acknowledge that any repair involving device disassembly may compromise manufacturer water-resistance ratings, seals, or ingress-protection features.
3C-Easy Markham does not guarantee water resistance after any repair, regardless of device rating or prior condition.
6. Pre-Existing Conditions & Hidden Damage
Devices presented for repair may contain pre-existing, latent, or progressive damage, including but not limited to:

Liquid corrosion

Board-level failure
-
Structural fatigue
3C-Easy Markham shall not be liable for failures caused by such conditions that were not reasonably detectable during initial inspection.
7. Estimates, Diagnostics & Additional Authorization
All estimates are non-binding until repair is completed.
If additional faults or required parts are discovered during repair, we reserve the right to pause service and seek further authorization.
Diagnostic or inspection fees may apply and are non-refundable once work has commenced.
8. Taxes
All sales are subject to Ontario Harmonized Sales Tax (HST) at 13%, as mandated by law.
Tax concerns must be directed to the relevant government authority. The Company has no discretion over statutory tax charges.
9. Part Disposal & Ownership
Unless you notify staff before repair begins that you wish to retain replaced parts, all removed or replaced components become the property of 3C-Easy Markham and may be recycled or disposed of.
10. Abandoned Devices
Devices left unclaimed for thirty (30) days after repair completion or service cancellation may be deemed abandoned and recycled or disposed of, subject to applicable law, to recover storage and handling costs.
11. Children on Premises
For safety reasons, children under the age of 12 must be accompanied by an adult at all times.
We reserve the right to request removal of any child whose conduct disrupts operations or customer safety.
12. Right to Refuse Service
We reserve the right to refuse or discontinue service at our discretion, including but not limited to:

Safety concerns

Abusive or threatening behavior

Suspected fraud

Non-compliance with store policies
13. Warranty Claims
All warranty claims are governed exclusively by the Company’s:
Warranty determinations are made based on inspection and testing, and the Company’s decision shall be final subject to applicable consumer protection laws.
14. Limitation of Liability
To the maximum extent permitted by law, 3C-Easy Markham shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:

Loss of use

Loss of data
-
Loss of business
arising from any repair or service.
15. Consumer Rights Notice (Ontario)
Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights or remedies that cannot be waived under the Ontario Consumer Protection Act, 2002, or other applicable consumer protection legislation.
16. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Acceptance
By proceeding with any in-store purchase or repair service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
If you do not agree with any portion of the above, please refrain from using our services and consider an alternative service provider.
