3C-Easy Markham

These Terms & Conditions (“Terms”) govern purchases of electronic components, replacement parts, accessories, and other merchandise from 3C-Easy Markham (“3C-Easy Markham,” “we,” “us,” or “our”) through our website at 3ceasymarkham.ca.

By placing an order through our website, you (“the customer,” “you,” or “your”) confirm that you have reviewed, understood, and agreed to these Terms, together with any policies, notices, product descriptions, and conditions incorporated into these Terms by reference.

Before completing an order, customers are provided with an opportunity to review their selected products, quantities, shipping information, billing information, and total charges and to correct errors before submitting the order.

For online purchases, customers will receive an order confirmation or other written record of the transaction containing the relevant order information in a form that can be retained, saved, and printed.

1. Scope of Online Sales

Our website offers electronic components, replacement parts, accessories, tools where expressly listed, and other related merchandise for sale.

Repair services are not sold, booked, diagnosed, or authorized through the online store. Products purchased online do not include installation or repair services unless a product listing expressly states otherwise.

Any repair services offered by 3C-Easy Markham are provided exclusively in-store and remain subject to:

  • physical inspection of the device;
  • confirmation of the device model and condition;
  • service and pricing approval;
  • component availability;
  • technical feasibility;
  • applicable diagnostic requirements; and
  • separate in-store documentation, service authorization, or written repair terms.

Purchasing a component from our website does not create an obligation for 3C-Easy Markham to install that component or accept the associated device for repair.

We do not offer mail-in repair services through the online store.

2. Product Descriptions, Identification, and Compatibility

Product descriptions, model numbers, photographs, specifications, manufacturer references, and compatibility information are provided to help customers identify and select products.

Customers are responsible for confirming the exact model, model number, regional variant, carrier variant, connector configuration, colour, size, revision, and other relevant specifications before ordering.

Similar-looking devices may use different and incompatible components. Compatibility with one model, generation, region, or carrier variant does not guarantee compatibility with another.

Manufacturer names, device names, model names, trademarks, and brand references are used solely for compatibility identification, nominative reference, or descriptive purposes. Their use does not imply affiliation with, authorization by, sponsorship from, or endorsement by the applicable manufacturer or trademark owner unless we expressly state otherwise.

Unless expressly described as genuine, original, OEM, manufacturer-authorized, or service-pack merchandise, products may be:

  • aftermarket;
  • compatible;
  • third-party manufactured;
  • refurbished;
  • reclaimed or pulled from another device;
  • remanufactured;
  • assembled using a combination of original and replacement materials; or
  • otherwise non-OEM.

Terms such as “premium,” “premium plus,” “high quality,” “compatible,” or similar quality designations describe the product category offered by 3C-Easy Markham and do not represent certification or endorsement by the original device manufacturer.

We make reasonable efforts to ensure that product descriptions and images are accurate. However, packaging, labels, minor design details, manufacturing revisions, colours, appearance, included materials, and product markings may vary without materially changing the product’s intended function.

Where an image is marked or reasonably understood to be illustrative, the product received may differ slightly in appearance.

Nothing in this section permits a material misrepresentation or limits rights that cannot lawfully be waived.

3. Components, Tools, Adhesives, Installation, and Use

All replacement components are sold as parts only unless the applicable product listing expressly states otherwise.

No tools, adhesive, installation materials, programming services, calibration services, pairing services, repair labour, technical support, or installation services are included unless explicitly stated in the product listing.

The customer is responsible for:

  • confirming compatibility before purchase;
  • inspecting the product before installation;
  • using appropriate tools and procedures;
  • following applicable safety precautions;
  • protecting the device and its data;
  • conducting proper pre-installation and post-installation testing;
  • arranging installation by a suitably qualified technician where appropriate; and
  • ensuring that the product is handled and used only for its intended purpose.

Replacement-part installation may require technical knowledge, specialized equipment, microsoldering, programming, calibration, software configuration, transfer of original components, or manufacturer-specific procedures.

Some devices may display parts-history messages, non-genuine-component notices, battery or display warnings, disabled features, unavailable diagnostic information, reduced water resistance, or other software notifications after a component is replaced. Unless expressly stated otherwise, the presence of such a message does not by itself establish that the replacement component is defective.

Opening or repairing a device may affect its manufacturer warranty, trade-in eligibility, water resistance, dust resistance, structural integrity, calibration, biometric functions, or future service eligibility.

Water-resistant seals and adhesives are not a guarantee of restored factory water resistance. A device that has been opened, repaired, damaged, or previously exposed to liquid should not be treated as waterproof or water-resistant.

Except where prohibited by law, 3C-Easy Markham is not responsible for damage, malfunction, data loss, loss of functionality, or other loss arising from:

  • improper installation or removal;
  • incorrect diagnosis;
  • installation into an incompatible device;
  • failure to disconnect or safely handle a battery;
  • technician error;
  • excessive heat, force, pressure, or adhesive;
  • damaged connectors, cables, sockets, boards, or mounting points;
  • modification, soldering, programming, or attempted repair;
  • failure to test the product before final installation;
  • reuse of damaged or unsuitable device components;
  • misuse or use outside the product’s intended purpose; or
  • damage to another component or device during installation.

4. Batteries and Shipping Restrictions

Lithium-ion and other rechargeable batteries are regulated products that require appropriate storage, packaging, transportation, and handling.

Battery products are eligible only for shipping methods and destinations permitted by the applicable carrier, transportation regulations, and our Shipping Policy.

Unless expressly stated otherwise:

  • replacement batteries are eligible only for approved ground shipping within Canada;
  • battery products cannot be shipped to the United States;
  • air shipping may be unavailable;
  • some remote destinations may be excluded; and
  • an order may require an adjusted shipping method or separate shipment.

Customers must not install, charge, puncture, crush, bend, short-circuit, disassemble, burn, or continue using a battery that appears swollen, leaking, overheated, damaged, deformed, or otherwise unsafe.

Spent or defective batteries must not be placed in household garbage. They should be taken to an authorized battery collection location in accordance with applicable local requirements.

5. Pricing, Payment, Currency, and Taxes

Unless expressly stated otherwise, all prices displayed on the website are in Canadian dollars (CAD).

Applicable taxes, including Ontario Harmonized Sales Tax where required, are calculated and charged at checkout based on the order and delivery information provided.

Full payment is required at checkout unless we expressly offer another payment arrangement.

The amount payable before order submission will generally identify:

  • the selected products;
  • quantities;
  • product prices;
  • discounts, where applicable;
  • shipping or delivery charges;
  • applicable taxes; and
  • the total amount payable.

Prices, promotions, availability, and shipping charges may change before an order is submitted.

We may correct typographical errors, technical errors, duplicate listings, inaccurate inventory information, or obvious pricing errors, subject to applicable law. If a material error affects an order that has already been submitted, we will contact the customer or take another action permitted by applicable law.

No term in these Terms gives us a right to cancel a binding consumer transaction where cancellation would be prohibited by applicable law.

Payments may be processed through third-party payment providers. The availability and approval of a payment method may be subject to the provider’s separate terms, security procedures, and authorization requirements.

6. Order Submission, Acceptance, and Availability

Submitting an order constitutes an offer to purchase the selected merchandise under these Terms. Receipt of an automated order confirmation confirms that the order was received but does not necessarily confirm final acceptance, allocation of inventory, or shipment.

Orders remain subject to:

  • inventory availability;
  • payment authorization;
  • address and transaction verification;
  • applicable shipping restrictions;
  • quantity limitations;
  • product or listing accuracy; and
  • our reasonable fraud-prevention and risk-management review.

Where permitted by law, we may decline or limit an order before shipment where reasonably necessary because of:

  • unavailable inventory;
  • an obvious pricing or listing error;
  • an unsupported delivery destination;
  • carrier restrictions;
  • payment failure;
  • inability to verify transaction information;
  • suspected unauthorized or fraudulent activity;
  • misuse of promotional offers;
  • resale quantities or unusual purchasing patterns;
  • legal or regulatory restrictions; or
  • circumstances making lawful fulfilment impracticable.

Where an order is lawfully cancelled after payment has been captured, the applicable amount will be returned to the original payment method. The time required for the credit to appear may depend on the bank, card issuer, or payment provider.

7. Order Verification and Fraud Prevention

To protect customers, payment systems, carriers, and our business from fraudulent, unauthorized, or suspicious transactions, all orders may be subject to security screening.

Where reasonably necessary, we may:

  • delay processing;
  • place an order on hold;
  • request confirmation of billing, shipping, identity, or payment information;
  • request that the customer contact us using information associated with the order;
  • limit quantities;
  • require an alternate payment or delivery arrangement;
  • refuse shipment; or
  • cancel and refund an order where permitted by law.

Customers must not provide false, misleading, unauthorized, or incomplete information.

We are not required to disclose confidential fraud-screening criteria, internal risk assessments, security procedures, or information that could compromise payment or transaction security.

Any personal information collected for order verification will be handled in accordance with our Privacy Policy and applicable law.

8. Shipping, Delivery, and Transit

Available shipping methods, fees, restrictions, and estimated transit times are displayed at checkout or described in our Shipping Policy, which forms part of these Terms.

Delivery and transit dates are estimates unless expressly guaranteed in writing. Processing time and carrier transit time are separate.

Orders may be delayed because of:

  • carrier backlogs;
  • severe weather;
  • public emergencies;
  • labour disruptions;
  • transportation interruptions;
  • remote-location service limitations;
  • address-verification issues;
  • statutory holidays;
  • customs or border processing where applicable;
  • dangerous-goods restrictions; or
  • other circumstances beyond our reasonable control.

Nothing in these Terms limits any statutory cancellation, refund, or delivery rights available under applicable consumer protection law.

Customers are responsible for providing a complete and accurate:

  • recipient name;
  • delivery address, including unit number;
  • postal code;
  • telephone number;
  • email address; and
  • other information reasonably required for delivery.

We are not responsible, except where applicable law provides otherwise, for delays, failed deliveries, returns to sender, address-correction charges, reshipping costs, or losses caused by incorrect, incomplete, outdated, or undeliverable information supplied by the customer.

Where tracking indicates delivery, a customer reporting non-receipt should contact us promptly so that available carrier procedures can be reviewed. Carrier investigations, declarations, photographs, identification, or other supporting information may be required.

9. Local Pickup

Where local pickup is offered, the order must be confirmed as ready before the customer attends the store.

An order confirmation does not necessarily mean the order is ready for collection.

We may request:

  • the order number;
  • the purchaser’s name;
  • government-issued identification;
  • the payment card used for the order; or
  • written authorization where another person is collecting the order.

Pickup orders must be collected during applicable business hours. Store closure days, holiday hours, and temporary operating changes may apply.

Ownership, risk, and responsibility for a pickup order transfer in accordance with applicable law when the merchandise is released to the customer or the customer’s authorized representative.

10. Inspection After Delivery

Customers should inspect the package and merchandise promptly after delivery and should report:

  • visibly damaged packaging;
  • missing products;
  • incorrect products;
  • shipping damage; or
  • apparent defects

as soon as reasonably possible.

Customers should retain the product, packaging, labels, shipping materials, and proof of purchase while a reported problem is being reviewed.

A request for prompt reporting helps us investigate the matter and pursue available carrier remedies. It does not eliminate or shorten any mandatory right or legal warranty period that cannot lawfully be waived.

Components should be fully tested before adhesives, protective films, seals, solder, permanent mounting materials, or other irreversible installation steps are applied.

11. Warranty Coverage

Product warranties are governed by the warranty policy applicable to the product at the time of purchase, including our Component Warranty Policy and Accessories Replacement Policy, where applicable. Those policies form part of these Terms.

Unless the listing or applicable policy expressly provides broader coverage, our voluntary product warranty is limited to verified defects in materials or manufacturing.

Warranty coverage may vary according to the product category, brand, condition, and product listing.

Except where prohibited by law, voluntary warranty coverage does not apply to problems caused by:

  • improper installation or removal;
  • installation-related damage;
  • accidental or physical damage;
  • impact, pressure, bending, crushing, or puncture;
  • cracked glass, damaged OLED or LCD panels, or torn flex cables;
  • liquid, moisture, corrosion, or contamination;
  • misuse, abuse, or neglect;
  • improper storage;
  • electrical short circuits or board-level faults;
  • excessive voltage, heat, or current;
  • unauthorized modification;
  • soldering or component transfer;
  • attempted repair;
  • normal wear and tear;
  • cosmetic deterioration;
  • use with an incompatible device;
  • incorrect model selection;
  • failure of another device component;
  • software, calibration, pairing, or programming limitations; or
  • damage occurring after delivery that is unrelated to a manufacturing defect.

Proof of purchase is required. We may also require photographs, diagnostic information, return of the product, testing, or another reasonable method of defect verification before approving a replacement, exchange, store credit, refund, or other remedy.

Customers must not return products without following the applicable return or warranty instructions.

Our voluntary warranty is in addition to, and does not replace, legal rights that cannot be excluded.

For Quebec consumers: Products are covered by the legal warranties provided under Quebec law, including warranties of fitness for ordinary use, reasonable durability, conformity with representations, and protection against hidden defects, where applicable. These legal warranties apply automatically and without charge.

12. Returns, Exchanges, and Replacements

Returns, replacements, exchanges, restocking charges, return-shipping responsibilities, and related remedies are governed by the applicable Return Policy, Component Warranty Policy, or Accessories Replacement Policy in effect at the time of purchase.

Unless required by law or expressly permitted by the applicable policy:

  • original shipping charges may be non-refundable;
  • the customer may be responsible for return shipping;
  • opened, installed, damaged, altered, soldered, programmed, or incompletely returned components may be ineligible for a discretionary return;
  • special-order, clearance, final-sale, hygienic, consumable, customized, or electronically activated products may be subject to additional restrictions; and
  • a restocking fee may apply to an eligible non-defective return.

A restocking fee does not apply where prohibited by law or where the return results from our error or another circumstance for which the fee cannot lawfully be charged.

Before approving a remedy, we may inspect, test, photograph, or otherwise evaluate the product and confirm its condition, identity, serial information, markings, and compatibility.

Approval of one return as a customer-service accommodation does not create an obligation to approve later returns outside the applicable policy.

Nothing in these Terms limits any non-waivable right or remedy under the Ontario Consumer Protection Act, 2002, Quebec consumer protection legislation, or other applicable law.

13. Data, Device Damage, and Third-Party Costs

Replacement components may be used in devices that store important personal or business data. Customers are responsible for maintaining appropriate backups before attempting installation or arranging third-party installation.

To the fullest extent permitted by law, we are not responsible for data loss, data corruption, account loss, device reset, software restoration, loss of access, or inability to retrieve information resulting from installation, diagnosis, device failure, or use of a replacement component.

The sale of a component does not include reimbursement for:

  • technician labour;
  • diagnostic charges;
  • installation costs;
  • removal costs;
  • third-party repair costs;
  • travel;
  • business interruption;
  • replacement-device rental;
  • loss of use; or
  • consequential expenses,

unless expressly required by applicable law or approved by us in writing.

14. Limitation of Liability

This section applies only to the fullest extent permitted by applicable law.

3C-Easy Markham will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to a product or transaction, including loss of use, loss of profits, loss of revenue, loss of opportunity, loss of data, business interruption, downtime, technician labour, or third-party repair costs.

To the fullest extent permitted by law, our aggregate liability for a claim relating to a particular product will not exceed the amount actually paid to us for that product.

These limitations do not apply:

  • where liability cannot lawfully be limited or excluded;
  • to rights or remedies that cannot be waived;
  • to liability arising from our intentional or gross fault where such liability cannot be excluded;
  • to personal injury or other damages where an exclusion is prohibited; or
  • where applicable consumer protection legislation provides otherwise.

For Quebec consumers, no exclusion or limitation in these Terms applies where it would contravene the Civil Code of Québec, the Consumer Protection Act, or another mandatory provision of Quebec law.

15. Customer Information and Communications

Customers are responsible for providing accurate, current, and complete order, billing, delivery, and contact information.

We may use the email address or telephone number associated with an order to communicate about:

  • payment or identity verification;
  • stock availability;
  • shipping;
  • pickup;
  • delivery problems;
  • product compatibility;
  • returns;
  • warranty matters; or
  • other information reasonably connected with the transaction.

Transactional communications are not necessarily marketing messages.

Customers should update us promptly where order information is incorrect. We cannot guarantee that an address, product, or order change can be completed after processing or shipment has begun.

16. Acceptable Use of the Website

Customers must not use the website to:

  • commit or attempt fraud;
  • use an unauthorized payment method;
  • provide false information;
  • interfere with website operation or security;
  • access data or systems without authorization;
  • introduce malicious code;
  • abuse promotional offers;
  • place orders for unlawful purposes; or
  • violate applicable law.

We may restrict access, cancel affected transactions where permitted by law, preserve relevant records, and cooperate with payment providers, carriers, or lawful authorities where reasonably necessary.

17. Intellectual Property and Compatibility References

Website content created by or for 3C-Easy Markham, including original text, branding, graphics, photographs, page designs, and policy wording, may be protected by copyright, trademark, or other intellectual property rights.

Customers may not reproduce, republish, scrape, commercially distribute, or misleadingly modify protected website content without permission, except as permitted by law.

All third-party trademarks, logos, brand names, trade names, and model names remain the property of their respective owners.

Third-party brand references are used solely for compatibility identification, nominative reference, or descriptive purposes. Unless expressly stated otherwise, 3C-Easy Markham is not affiliated with, endorsed by, sponsored by, or authorized by the applicable brand owner.

18. Complaints, Chargebacks, and Disputes

We are committed to reviewing customer concerns fairly, reasonably, and professionally.

Before initiating a chargeback or escalating a complaint through a third party, customers are encouraged, where reasonable, to contact us and provide:

  • the order number;
  • a clear description of the concern;
  • relevant photographs or videos;
  • diagnostic or installation information where applicable; and
  • a reasonable opportunity for us to investigate and respond.

This request does not prevent a customer from exercising a legal right or meeting a legally applicable deadline.

Submitting false information, withholding material information, or claiming that an authorized transaction was unauthorized may constitute chargeback abuse or fraud.

Where a concern cannot be resolved directly, either party may pursue an appropriate complaint process, the Better Business Bureau process, or a court or tribunal of competent jurisdiction.

Nothing in these Terms requires a consumer to waive a statutory forum, remedy, or procedural protection that cannot lawfully be waived.

19. Governing Law

Subject to mandatory consumer protection provisions, these Terms and transactions with 3C-Easy Markham are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

This governing-law provision does not deprive a consumer in another province or territory, including Quebec, of mandatory protections that apply to the transaction and cannot lawfully be waived.

20. Severability and No Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.

Our failure to enforce a provision in one instance does not waive our right to enforce it later.

A customer-service accommodation, exception, or goodwill remedy does not amend these Terms or establish an ongoing practice unless confirmed by us in writing.

21. Entire Agreement and Policy Priority

These Terms, together with the applicable product listing, order confirmation, Shipping Policy, Return Policy, Privacy Policy, Component Warranty Policy, Accessories Replacement Policy, and any other policy expressly incorporated by reference, form the agreement governing the online purchase.

Where there is a conflict:

  1. mandatory applicable law prevails;
  2. a written term specifically agreed to for the individual transaction prevails;
  3. the product listing prevails concerning product-specific inclusions, compatibility, or warranty coverage;
  4. the applicable specialized policy prevails concerning its subject matter; and
  5. these general Terms apply in all other respects.

22. Changes to These Terms

We may revise these Terms from time to time, subject to applicable law.

The version displayed at the time an order is placed will generally govern that order. A later revision will not retroactively reduce rights arising from an earlier transaction unless the change is required by law or expressly accepted by the customer.

The “Last updated” date identifies the most recent revision.

23. Language

A French version of these Terms is available.

Where Quebec law requires a French version of a consumer contract or contract of adhesion to be provided before the customer chooses to contract in another language, the French version will be made available in accordance with that requirement.

For customers who expressly choose the English version after being provided with the French version: The parties expressly request that these Terms and the documents related to the transaction be drawn up in English.

Nothing in this section restricts a language right that cannot lawfully be waived.
